We Should Have Listened

The following story is true.

A long time ago, in a land far far away, there was a man. His name was Hunter. He had a friend named Jaro, and they saw each other through the darkest, and lightest, of times in their adopted home, named Budapest, Hungary.

Both men were steel headed and knew what they wanted, and said things that they thought were true. Most times, they were true. Some times, they weren’t. But not for lack of trying, or lying. They just did not know all possible meanings to the questions they posed.

One day, they decided something: they would live together in an unbeknownst flat. They figured with all the time they spent together, it would make sense that they should live together, because really, who wants to walk home in the dead of night in the freezing cold when they could walk across their living room instead?

Three weeks into their flat searching, the search was coming up dry. It was stressful, because each knew what they wanted, but they could not find what they were looking for. There was a strict set of rules they wanted to see implemented in this new flat, but each time they went to see a prospective property, it came up lacking.

Finally, a day came that would change everything. It was a Sunday. Hunter, tired of waiting for Szilvi, Jaro’s girlfriend, to find a flat that seemed un-findable, got onto the website that never seemed to fail. Craigslist.

There, upon chance, he saw something that was incredible, nay, indescribable, for the price. A flat in the center of the city, nearest the most expensive street in the whole of Budapest, for a pittance.

He emailed the proprietor immediately, stating that he was interested in viewing.

One day later, Hunter and Jaro, with their girlfriends, Noemi and Szilvi, walked through this flat wondering how it could be so good. And really, how could it be that good? The owner, named Sean, from Canada, seemed like a nice gay man with all the right answers. Everything Jaro and Hunter asked, he seemed to have the answer that both were looking for.

Within 10 minutes, they were negotiating the terms of the lease. It was too good to be true. Everything they were looking for in a flat, in the right neighborhood, for the right price, was placed in front of their face, on a silver platter. Both were ecstatic with the prospect of living in such an area, with such a nice flat, with such a knowing landlord.

They would say later to themselves that they could see themselves hanging out with Sean, kicking it in some unnamed bar and laughing at some rude joke.

One week later, Jaro and Hunter sign a lease, right in their nice new future flat. Everything seems to be working. Sean has all the paperwork, both the leases, in English and Hungarian, that is custom in Hungary.

Two weeks remain before they move in to the flat. Sean states that some things must be re-painted, but neither of the men are much listening. They are admiring the new digs around them. Things are going well for both Jaro and Hunter.

One week before they are supposed to move in to their flat, Hunter finds he must travel to Prague on a business trip a couple days before the set move in date. He relays this information to both Sean and Jaro, both of which acknowledge.

One day before leaving for Prague, and three days before the move in date, Sean tells both Jaro and Hunter that they can move in their stuff, but that they will have to wait until the actual move in date to, well, move in, because they are re-finishing the floors. Since Sean has kept in communication with Hunter and Jaro continually over the last three weeks, and being the nice guy that he is, they agree and thank him for the opportunity.

Hunter leaves for Prague, and waits to hear from Jaro, when he is lounging in the flat without him after moving in. Hunter thinks he will get a call, stating something like this: I’ve pissed in all the corners and now you’ll have to piss in the corners you want. Either way, the whole flat is mine and haha you are not here to stop me.

Or at least, something much funnier than this, but that seems funny in Hunter’s mind.

Instead, Hunter gets a very unnerving phone call from Jaro the day after Jaro is supposed to have moved in. It goes something like this:

I’ve got some bad news. I don’t know where Sean is. He’s disappeared. I keep trying to call him and he’s not picking up. I have no idea whats happening. I’m practically homeless at the moment, but this shit is ridiculous. That flat has all our stuff in it, and we’re not able to sleep in it? What the fuck is this shit?

To which Hunter dutifully replies: Wait, what?

Now both Jaro and Hunter are searching for answers where none exist. What IS going on? The next few hours Hunter cannot think straight, because his mind is trapped in the situation miles away, in Budapest. Still in Prague, he cannot deny the growing helplessness that grips his gut. No…. He couldn’t have.

On returning to his hotel room, Hunter grabs his laptop and proceeds out of his hotel room and into the stairs right outside the lobby. The wifi signal has decided to boycott his room, so he is forced to sit on the stairs and write a thoughtful yet condescending email to Sean while listening for people who are approaching, wary of the looks he might receive while sitting on the stairs outside the lobby, writing an email.

He hits send, and takes a deep breath. This should all be over in a… and then, there is an email in his inbox, instantly.

Send failed. Recipient’s email does not exist.

That was Sean’s email back, because his email was deleted.

Now Hunter is finally seeing the big picture, and just as he drops his hand into his pant’s pocket to call Jaro, Jaro calls him.

You’re not going to believe it, he starts. But Hunter already does, though he is still in shock.

The lease, worth something around $1,400 with 2 months deposit and first month rent, is gone. Sean Kirkham, if that is his real name, has just conned two Americans in Budapest out of a shitload of money.

Later, Jaro calls Hunter to tell him the story keeps unfolding, that there were multiple people who were in the same predicament: They all signed leases and gave over their hard earned money. They all were caught with their pants down.

Later still, Jaro calls again to tell him that now its official, that he absolutely knows they were fleeced. And how is that, Hunter wonders aloud. Because the owner is coming to the flat now to open the door, to let us get our stuff.

For a second, this doesn’t make sense. What do you mean, the owner? Sean owned the flat.

No, Hunter, he didn’t. He never owned shit.

Much later, Jaro calls for the last update. He tells Hunter that their bags and boxes with all their belongings have been ransacked. Some have been stolen, but its still not clear what. Hunter asks about his most important items he knows were stored in his suitcase, but Jaro cannot be sure. All the contents of their bags are strewn across the floor. It’s like carnage, he keeps saying.

Hunter sits in a restaurant, a restaurant from his past, when he used to live in Prague, when things looked peachy to begin with. But as he learned, the life that was supposed to happen in Prague never happened. And as he clicks off the phone, he sits watching all the smiling and laughing faces around him, and wonders about the future.

Ahead of him, there are many things he can see, but what he cannot see, is where he will be sleeping the night he gets back to his home, Budapest. That place, was supposed to be reserved for his new and tidy room in Sean’s flat, but was so forcefully shattered by the enigma that was Sean, a con artist that caught the best of them.

Hunter recalls what should have been a flashing light in the darkness, showing them the way. Fifteen minutes after looking at the flat, and agreeing with Sean about the price and time of move in, Jaro, Hunter, Szilvi and Noemi sit at a small bar on Andrassy ut, the most expensive street in Budapest. What they think is their new flat is just around the corner, and they are all glowing with the discovery that they finally are moving up in the world.

Everything seemed to working. Everything seemed to be right. And Jaro says: It just seems too good to be true.

And we should have listened.

Because some people don't automatically think the worst of others. And there's a certain amount of trust between expats living in a foreign country. They usually don't fuck their own people over. Unless you like burning bridges and walking around with a price over your head.

THE SECRET OF LIFE OF THE SNITCH WHO SHUT DOWN THE LIMELIGHT
On the eve of the Peter Gatien drug-conspiracy trial, as the embattled entrepreneur struggles against City Hall to reopen the Limelight, one piece of this clubland puzzle is still missing. His name is Sean Kirkham.
Though the Prada and Gucci suits Kirkham once sported have been replaced by a blue prison smock, handcuffs, and jeans, the 25-year-old still cut quite a handsome if bewildered figure as he was escorted into Brooklyn federal court. It's easy to see why this tall, slender, and fine-featured descendant of Inuits was so easily accepted into the fabulous demimonde of New York and Miami nightlife.
Kirkham is the Drug Enforcement Agency informer who infiltrated the cocaine and Ecstasy scene at the Limelight and then offered to sell indicted club czar Peter Gatien information about government misconduct in the case. Kirkham's plan backfired when Gatien's lawyer, Benjamin Brafman, thinking that his client was being set up, contacted the FBI. The feds and Gatien's defense team set up a sting that snared Kirkham on charges of lying to a federal agent. After pleading guilty in October 1996, Kirkham fled back home to Canada, only to turn himself in three months later.
Now a contrite Kirkham is ready to plead guilty for failure to appear and to face sentencing on the other charge. But Judge Stirling Johnson Jr. is involved in an important trial, so Kirkham will have to wait until early next year to find out his fate. "I'm anxious to get this over with," he said, just before appearing in court. "I want to get on with the rest of my life even if part of it is behind bars."
Take your pick. Either Sean Kirkham is crazy or the feds are crooked. How else to account for the explosive story Kirkham told the Voice from his cell at the Metropolitan Detention Center in Brooklyn--and which he repeated in a "Dear Judge" letter he says he sent to Johnson. Kirkham alleges not only that the government manufactured and embellished evidence against Gatien, but that he had what Brafman refers to in court documents as "an extraordinary personal relationship" with a member of the prosecution team prior to joining the Gatien case. (The Justice Department's Office of Profession Responsibility in Washington recently investigated these charges and found them baseless.) Kirkham claims this prosecutor introduced him to the DEA agents who used him to set up buys in Gatien's clubs.
It's hard to believe somebody who has a track record of lying, and who has sold not only information but, as he readily admits, his body. Yet if this is a lie, it's a very elaborate fabrication. And Kirkham has nothing to gain from making these startling accusations. In fact, he has a lot to lose. Perjury charges could follow any testimony Kirkham gives at the Gatien trial that contradicts the plea-bargain agreement he signed, admitting he "falsely stated and represented to a Special [FBI] Agent...that he had information and tape recordings reflecting improper conduct by agents of the Drug Enforcement Administration and a prosecutor responsible for the prosecution of Peter Gatien, when, in fact,...he did not have any such information or tape recordings."
Kirkham now wants to retract the latter half of that admission. "It's true that I did lie to a federal agent about Peter Gatien's people approaching me, when the truth was it was the other way around," he says. "But it's not true that I invented the allegations of government misconduct. And I'm willing to testify to that at the upcoming Gatien trial."
Sean Kirkham was born inside the Arctic circle, on a reservation in the Northwest Territories of Canada. Orphaned at an early age, he grew up with foster parents in a middle-class suburb of Montreal. Following his high school graduation, and after his adopted family found out he was gay, Kirkham left home for Europe, where he bummed around, working odd jobs--a waiter in Paris, a tour guide in Salzburg, a doorman at a club in Greece. He was eventually deported from Geneva back to Montreal after his tourist visa ran out.
In 1990, the then 19-year-old Kirkham moved to New York with only 90 Canadian dollars in his pocket. He lived on the streets and slept in homeless shelters or on subway trains. He eked out a modest existence by hustling in the old Times Square, living off "the generosity of some sympathetic strangers," as he puts it.
In December 1993, Kirkham applied for a job as a busboy at Club USA, Peter Gatien's defunct Times Square dance hall. It was there that Kirkham first met Gatien, Michael Alig, Lord Michael, and other major players in the current clubland scandal. Kirkham disliked Alig, then at the height of his influence. "He was snotty, sarcastic, and disgusting," remembers Kirkham. "He used to throw pee out of the window onto the crowd below waiting to get in." And he wasn't particularly impressed by Gatien: "Personally, the man left a sour taste in my mouth."
He claims he was sacked from Gatien's employ after he approached a local politician with the accusation that the club was paying off the Fire Department. The pol, who requested anonymity, confirmed Kirkham's story: "He came to me with this accusation, but there was no specific evidence, so there was nothing I could do," she relates. "He seemed very innocent about the ways of the world." While Gatien insists his former employee is mistaken, Kirkham still maintains, "I saw cash being passed from a club employee to a fireman."
Sean Kirkham is a club buster by trade. He got into this unusual line of work after he moved from New York to Miami in 1994. He was soon convicted of credit card fraud. Kirkham claims he turned himself in because he was ashamed of what he was doing. After serving nine months in M.C.C. Miami--home to Manuel Noriega--a chance meeting with an FBI agent in the prison visiting room led to Kirkham going to work for the feds.
His first job was to infiltrate the Miami Beach Russian Mafia, which was then trying to forge alliances with Colombian drug traffickers in the area. He visited a nightclub and strip joint named Porky's and tried to befriend the owner, reputed Russian mobster Ludwig Fainberg, known as Tarzan because of his long hair and muscular build. Kirkham failed in his mission to get a job at the club, but Fainberg was arrested earlier this year for trying to sell two Soviet military helicopters and a submarine to the Cali cartel.
Kirkham's next project was more successful--he set out to infiltrate the trendy South Beach party scene. His delicate good looks made him stand out amid the beefy muscle boys on the circuit. Charming and unfailingly polite, he easily penetrated the trendiest clubs. Maxwell Blandford, manager of Miami hot spot Warsaw, remembers: "Sean used to be at all the fabulous parties. He walked right in and never had a problem. I remember he had Madonna's home phone number in his address book." Kirkham's address book also contained what to one observer looked like "an A-Z of Florida law enforcement."
"The gossip on the beach was that he was a police informer," says Blandford. Yet this club owner took the rumors swirling around Kirkham with a grain of salt. It was only when he noticed Kirkham flashing big bills, and put that together with the fact that "Sean definitely knew a lot of cops," that Blandford began to suspect he was in league with enforcement agents. Blandford was none too surprised when he "heard through the grapevine that Sean was the one who got the clubs shut down."
In January 1996, authorities raided and temporarily closed Paragon, Twist, Groove Jet, and Glam Slam, all prominent South Beach hot spots. Kirkham claims the police were acting on information he provided about drug dealing in the clubs. In the space of three years, Kirkham claims to have worked with the DEA, the FBI, the Bureau of Alcohol, Tobacco, and Firearms, the Hollywood Police Department, the Miami Beach Police Department, and several special narcotics task forces. His pay? Kirkham says he sometimes netted $5000 a case. He contends that his clandestine efforts led to the seizure of 10 kilos of cocaine, 5000 hits of Ecstasy, two kilos of pot, and 400 bottles of ketamine.
"I was feared by local drug dealers," claims Kirkham. "They would arrange meetings with me to verify my status as an informant. They would then provide me with information on rival dealers and vice-versa. I was befriended by a number of dealers who thought it was in their best interests to keep me out of harm's way."
Wilfredo Fernandez, a spokesperson for the U.S. Attorney's office in Miami, confirms that Kirkham did help Federal Prosecutor Michael Mulaney in a major drug bust: "Mr. Kirkham was a confidential informant for us in December 1995 and testified in the case of US v. Mario Santoro et al. about a shipment of cocaine from Miami to New York."
Other law enforcement officials contacted by the Voice tried to downplay the importance of Kirkham's undercover activities. "I'm telling you straight up that we never worked together," said one FBI agent, speaking off the record. "Kirkham was basically nothing. He claims to have worked with the whole world." The agent's partner merely said: "I can't make any comment on Sean Kirkham. I could lose my job. I can't even confirm that I knew the guy."
After testifying against a Colombian drug dealer in Miami in 1995, Kirkham moved back to New York. He worked as a male escort out of his Upper East Side apartment. It was at that time that Kirkham first made contact with the DEA.
"I played a major role in Mr. Gatien's troubles," says Kirkham. "I made as many as 15 to 20 drug buys from promoters, drag queens, and employees of the Limelight and Tunnel." In return for his services, Kirkham claims he was promised 25 per cent of everything confiscated from Gatien if the club owner was convicted. He says he earned as much as $1000 a week from the DEA while helping out on the Gatien case.
Earlier this year, Eric Friedberg, an official of the U.S. Attorney's office in Brooklyn, told The New York Times that Kirkham played only a peripheral role in the case. Friedberg was quoted as saying that Kirkham was only used "for intelligence information" and in an unsuccessful attempt to broker a purchase of Ecstasy. Gatien, on the other hand, firmly believes that, after Friedberg, Sean Kirkham is the man most responsible for closing the Limelight.
The case against Gatien started to go awry when, Kirkham claims, the DEA agents lied to the grand jury about observing the club owner in his office snorting cocaine through a device known as "a one-hitter." Kirkham maintains that he secretly taped one of the agents admitting that he had falsified evidence. It was this tape recording, along with others, that Kirkham tried to sell to Gatien, claiming they contained proof of government misconduct in the case. Unfortunately for Kirkham, Gatien's attorney, Ben Brafman, thought his client was being set up. So he contacted the FBI.
Kirkham's double-dealing began to unravel after he met at a Park Avenue hotel with someone he thought was Gatien's private investigator. In fact it was an undercover FBI agent named Pat Colgin. "He offered me money for the tapes, which I foolishly accepted," says Kirkham. "I went back to Miami and kept in touch with Colgin, still thinking he was an investigator for Mr. Gatien."
Kirkham returned to New York at the request of the DEA agents, who said they wanted to pay him $5000 they said they owed him. When he arrived at the agency's West Side offices, he was arrested.
"Mr. Friedberg told me to disappear back to Miami, do everything he said, and not to contact any media," Kirkham maintains. "If I didn't do what he said, he told me that he would slam me with additional charges. In a period of 30 minutes, I was arraigned, pled guilty to lying to an agent, given bond, and let go--all under the watchful eye of Mr. Friedberg, who was sitting at the back of the court. I wanted to get out of Mr. Friedberg's reach. His threats were a big factor in my decision to take off for Canada." (Contacted by the Voice, Friedberg said he couldn't comment on the case because the judge had imposed a gag order.)
So what happened to the tapes? Kirkham claims that his Miami roommate mistakenly threw them out.
"I've worked with 75 to 100 agents in a period of three years," continues Kirkham. "And I've never experienced anything like the Gatien case. Prosecutors never had to lie in the other cases I was involved in because the evidence was always there. I think Mr. Gatien is guilty of knowing drugs were being used and sold in his clubs. But I don't think Gatien is guilty of supplying drugs, organizing the distribution of them, or hiring dealers to personally work for him, as the government claims."
Is Sean Kirkham a money-hungry whore attempting to get back at his former handlers, who he believes downplayed his involvement in the Gatien case, or is he that rare breed, a hustler with a sense of ethics? "I know I'm not the most righteous person in the world," Kirkham admits, "but I do know the difference between right and wrong."
Yet in this shady world of informers and dope peddlers, it's hard to tell the difference between truth and drug-induced fantasies, harder still to distinguish between friends and enemies. So who knows what Gatien means when he says, "Sean Kirkham has caused a lot of distress in my life, but I have some sympathy for him. I, more than most, understand how the government can manipulate and scare people."

Defendant-Appellant Sean Kirkham appeals from a judgment of conviction entered May 1, 1998, in the United States District Court for the Eastern District of New York (Sterling Johnson, Jr., Judge), upon the entry of his plea of guilty. Kirkham was convicted on a one-count information charging him with making false statements to FBI and DEA agents, in violation of 18 U.S.C. 1001, and on a one-count indictment charging him with failing to appear for sentencing, in violation of 18 U.S.C. 3146(a)(1). He was sentenced to two consecutive sentences of 33 months and 24 months of imprisonment, respectively, for a total of 57 months, to be followed by two concurrent 3-year terms of supervised release. On appeal, Kirkham initially raised several issues pertaining to his sentence, claiming that: (1) the district court improperly enhanced his offense level based on the erroneous finding that the DEA and FBI agents were the "victims" of his false statements; and (2) the court failed to articulate adequately the grounds for, and justify the extent of, the upward departure.

Following oral argument, this Court requested additional briefing on the issue of whether the two offenses should have been grouped under the Sentencing Guidelines, in light of the fact that 18 U.S.C. 3146(b)(2) requires that any sentence of imprisonment imposed for failure to appear be made to run consecutively to any other sentence. We find that the two convictions should have been grouped, and that as a result of that grouping, Kirkham should have been sentenced within a single guideline range of 24 to 30 months, the sentences for both convictions running consecutively within that range (aside from any upward or downward departures that may be imposed). We therefore vacate and remand the judgment for resentencing.

I. FACTUAL BACKGROUND

The facts of this case arise out of the government's investigation of illegal activity at the "Tunnel" nightclub in New York City. In early 1996, Peter Gatien, the owner of the Tunnel, was indicted along with over 20 other defendants on charges related to drug distribution at the nightclub. Defendant- Appellant Kirkham worked as a confidential informant for a brief period during the summer of 1996, assisting the government with its investigation of Gatien and his co-defendants.

Sometime during the summer or fall of 1996, Kirkham approached Gatien's defense attorneys and advised them that he had information concerning government misconduct in the prosecution of Gatien. He claimed he had tape recordings that provided evidence of the alleged misconduct. On September 6, 1996, Gatien's defense attorney related this information to the government, whereupon the government commenced an undercover investigation of Kirkham.

On September 11, 1996, an FBI agent, posing as an investigator employed by Gatien, met with Kirkham to "negotiate" for the purchase of the alleged tape recordings. Kirkham advised the agent that DEA agents had fabricated evidence against Gatien, and that Kirkham had access to government files relating to Gatien by virtue of a romantic relationship he was having with one of the Assistant United States Attorneys assigned to Gatien's case. He then sold the agent a tape, which he said contained conversations between himself and the DEA agents. Although Kirkham stated that the tape supported his claims of misconduct, in reality, the tape contained only benign conversations. Kirkham continued to have frequent telephone conversations with the FBI agent throughout September and early October 1996, reiterating his claims of DEA misconduct and reasserting that he was having a romantic relationship with a prosecutor.

Kirkham apparently realized soon thereafter that his plan to defraud Gatien's attorneys was not working, so he directed his efforts to defraud elsewhere. On October 15, 1996, Kirkham contacted his DEA controlling agent and claimed that Gatien's investigator (the undercover FBI agent) had contacted Kirkham in the hopes of obtaining information related to the government's investigation. Kirkham was arrested on October 18, 1996, and pleaded guilty that same day to a criminal information charging him with lying to federal agents in violation of 18 U.S.C. 1001. During his allocution, Kirkham admitted that he had falsely stated there was misconduct by both the prosecutor (the alleged romantic relationship) and DEA agents (the manufacturing of evidence against Gatien), and that he had falsely stated that Gatien's agent had approached him initially.

On July 30, 1997, Kirkham failed to appear at his scheduled sentencing hearing, fleeing to Vancouver, Canada. A warrant was issued for his arrest. From Vancouver, Kirkham made several telephone calls to Gatien's defense attorney, again asserting that he had evidence of government misconduct. Gatien's attorney tape-recorded at least one of these conversations and presented the tape to the government as evidence of misconduct, but an investigation later concluded that Kirkham's claims were without merit.

Kirkham voluntarily surrendered in October 1997. He was subsequently indicted by a grand jury in the Eastern District of New York for intentionally failing to appear before the District Court for sentencing, a violation of 18 U.S.C. 3146(a)(1). Kirkham pleaded guilty to the indictment on December 18, 1997.

Even after pleading guilty, Kirkham continued to assert that he had had a romantic relationship with a prosecutor and that he had information of DEA misconduct on one occasion making these assertions in a letter to the district court judge. His allegations with regard to the prosecutor eventually prompted an investigation by the Office of Professional Responsibility ("OPR"), which found Kirkham's claims to be false.

The two-level adjustment for obstruction was based on Kirkham's failure to appear for sentencing. See U.S.S.G. 3C1.1. The three-level victim adjustment was imposed pursuant to U.S.S.G. 3A1.2(a), and was based on the fact that Kirkham's statements had undermined the credibility of government employees, negatively affected the careers of the DEA agents, and had caused the prosecutor professional and personal embarrassment.

Under U.S.S.G. 3D1.2(c), where one conviction is used to enhance the offense level of the other, the two convictions are normally grouped. Since Kirkham's failure to appear caused a two-level enhancement to be added to his false-statements conviction, the Probation Department grouped his two convictions, giving him an overall offense level of 15. Kirkham's Criminal History Category was calculated as III, so the applicable guideline range was 24-30 months.

The Probation Department also suggested a possible ground for an upward departure, since Kirkham had continued to make false statements after pleading guilty. Because the Guidelines did not provide a mechanism for considering this behavior as relevant conduct, the Probation Department informed the court that it could consider the conduct as a basis for an upward departure as per Policy Statement section 5K2.0.

Kirkham was sentenced initially on April 24, 1998, before Judge Johnson. The district court apparently did adopt the Probation Department's calculations of the two offense levels as 15 and 12. However, the court did not follow the PSR's recommendation that the two offenses be grouped pursuant to U.S.S.G. 3D1.2(c). In addition, Judge Johnson imposed an upward departure, stating that

[i]n this particular instance the allegations made by this defendant [were] outside the heartland of the normal false statement case. It was atypical. His statements, if believed, fraternizing with a prosecutor and illegal acts by DEA agents was unethical conduct and if believed, would be a career ending move. I also think that the statements that the defendant made were egregious, malicious and vicious and they were intentional. So, therefore, I am going to upwardly depart . . .

Judge Johnson then stated that he was sentencing Kirkham to 20 months on the failure-to-appear conviction and 37 months on the false statements conviction, the sentences to run consecutively to each other, for a total of 57 months of imprisonment. He also ordered that the term of imprisonment be followed by two concurrent 3-year terms of supervised release.

On May 1, 1998, the district court held an additional hearing to clarify the sentence that it had imposed. At that time, Judge Johnson said that he had adopted the Probation Department's recommendation with respect to the total offense level. He then departed, as to the first conviction (false statements), to impose a period of 33 months of imprisonment, "because this false statement was outside the heartland . . . and it was egregious and malicious . . . ." On the second conviction, he sentenced Kirkham to 24 months, to run consecutive to the 33 months. He added, "I sentence the defendant . . . as I said before I think on the Count 1 it was egregious, malicious and the defendant intended to issue false statements even after he pleaded guilty."

Judgment was entered on May 1, 1998. This appeal followed.

II. DISCUSSION
20

A. Grouping and Consecutive Sentencing for Failure to Appear
21

The primary issue on appeal is whether the Sentencing Guidelines required the district court to group Kirkham's offenses and, if so, whether such grouping is consistent with the consecutive sentencing language of 18 U.S.C. 3146.1 That statute provides, in pertinent part, as follows:

3146. Penalty for failure to appear
22

(a) Offense.-- Whoever, having been released under this chapter knowingly--
23

(1) fails to appear before a court as required by the conditions of release; or
24

(2) fails to surrender for service of sentence pursuant to a court order; shall be punished as provided in subsection (b) of this section.

(b) Punishment--
26

(1) The punishment for an offense under this section is
27

(A) if the person was released in connection with a charge of, or while awaiting sentence, surrender for service of sentence, or appeal or certiorari after conviction for
28

(i) an offense punishable by death, life imprisonment, or imprisonment for a term of 15 years or more, a fine under this title or imprisonment for not more than ten years, or both;
29

(ii) an offense punishable by imprisonment for a term of five years or more, a fine under this title or imprisonment for not more than five years, or both;

(iii) any other felony, a fine under this title or imprisonment for not more than two years, or both;

(2) A term of imprisonment imposed under this section shall be consecutive to the sentence of imprisonment for any other offense.

There are three Guidelines provisions at issue, all of which interact with each other and with the statute. First, U.S.S.G. 3D1.1 sets forth the procedure for determining an overall offense level on multiple counts that are grouped. Section 3D1.1(a) of the 1997 Guidelines provides that,

[w]hen a defendant has been convicted of more than one count, the court shall:

(1) Group the counts resulting in conviction into distinct Groups of Closely Related Counts ("Groups") by applying the rules specified in 3D1.2.
37

(2) Determine the offense level applicable to each Group by applying the rules specified in 3D1.3.
38

(3) Determine the combined offense level applicable to all Groups taken together by applying the rules specified in 3D1.4.

If these rules are applied, the Guidelines require that Kirkham's failure-to-appear conviction be grouped with his false statement conviction, as it is a closely related count. See U.S.S.G. 3D1.2(c) (grouping appropriate when one count is treated as a specific offense characteristic of the other). Taking into account the adjustments recommended by the Probation Department and adopted by the district court, this group would be assigned a combined offense level of 15. See U.S.S.G. 3D1.4 (combined offense level determined by using the highest offense level within that group).

However, the Guidelines also contain exceptions to the grouping rules of section 3D1.1(a). Specifically, section 3D1.1(b) provides that "[a]ny count for which the statute mandates imposition of a consecutive sentence is excluded from the operation of 3D1.2-3D1.5." Instead, "[s]entences for such counts are governed by the provisions of 5G1.2(a)." U.S.S.G. 3D1.1(b). Section 5G1.2(a), in turn, provides that "[t]he sentence to be imposed on a count for which the statute mandates a consecutive sentence shall be determined by that statute and imposed independently."

Thus, at first glance, it may appear that the statute at issue, 18 U.S.C. 3146, mandates that Kirkham's two convictions not be grouped in accordance with U.S.S.G. 5G1.2(a). As noted at the outset, section 3146(b) requires that any term of imprisonment for failure to appear be consecutive to the sentence for the underlying offense(s). However, a more careful reading of the statute reveals that U.S.S.G. 5G1.2(a) does not apply. The statute at issue, 18 U.S.C. 3146, does not specify a set term of imprisonment to be imposed; instead, it specifically states that a violation may be punished by a fine, imprisonment, or both. See 18 U.S.C. 3146(b). The statute's only requirement is that, if a sentence of imprisonment is imposed (as opposed to simply a fine), that sentence must be imposed to run consecutively to any sentence imposed for the underlying offenses. As a result, by their terms, sections 3D1.1(b) and 5G1.2(a) do not apply, and thus the failure-to-appear conviction should be grouped with the underlying offense.

Importantly, we note that such a reading of the statute and the 1997 Guidelines is consistent with the Commentary to the 1998 Sentencing Guidelines, which do not differ in substance from the 1997 Guidelines, but which do supply further clarity.2 Because this Court is required to apply amendments to the Guidelines that clarify their application on direct review, see United States v. Hendrickson, 26 F.3d 321, 330 n.6 (2d Cir. 1994); United States v. Colon, 961 F.2d 41, 45 (2d Cir. 1992), we must consider the scope and effect of the 1998 Guidelines as well.

The 1998 Guidelines contain a specific provision addressing convictions under 18 U.S.C. 3146 that is consistent with both the Guidelines and the consecutive sentencing language of section 3146(b). Amendment 579 to the 1998 Guidelines contains amendments to sections 3D1.1, 3D1.2, 5G1.2 and 2J1.6, among others. Application Note 3 to U.S.S.G. 2J1.6 now provides, in relevant part, as follows:

In the case of a conviction on both the underlying offense and the failure to appear [except with regard to one exception not applicable here], the failure to appear is treated under 3C1.1 (Obstructing or Impeding the Administration of Justice) as an obstruction of the underlying offense, and the failure to appear count and the count or counts for the underlying offense are grouped together under 3D1.2(c). (Note that 18 U.S.C. 3146(b)(2) does not require a sentence of imprisonment on a failure to appear count, although if a sentence of imprisonment on the failure to appear count is imposed, the statute requires that the sentence be imposed to run consecutively to any other sentence of imprisonment. Therefore, unlike a count in which the statute mandates both a minimum and a consecutive sentence of imprisonment, the grouping rules of 3D1.1 - 3D1.5 apply. See 3D1.1(b), comment. (n.1), and 3D1.2, comment. (n.1).) The combined sentence will then be constructed to provide a "total punishment" that satisfies the requirements both of 5G1.2 (Sentencing on Multiple Counts of Conviction) and 18 U.S.C. 3146(b)(2). For example, if the combined applicable guideline range for both counts is 30-37 months and the court determines that a "total punishment" of 36 months is appropriate, a sentence of 30 months for the underlying offense plus a consecutive six months' sentence for the failure to appear count would satisfy these requirements.

U.S.S.G. 2J1.6, Commentary, App. n. 3 (1998)(emphasis added). Thus, the 1998 Guidelines clearly state that a conviction under section 3146 must be grouped with the underlying offense pursuant to the grouping rules of section 3D1.2.

Furthermore, as the 1998 Guidelines unambiguously state, Amendment 579 in the 1998 Guidelines was intended "to clarify how several guidelines provision, including those on grouping multiple counts of conviction, work together to ensure an incremental, consecutive penalty for a failure to appear count." See U.S.S.G. Supplement to App. C, Amendment 579 (1998). Because Amendment 579 is a clarification that must be given effect on direct review, we must vacate Kirkham's sentence and remand to the district court for resentencing in light of this decision and the clarification within the 1998 Guidelines.

As noted above, grouping yields an overall offense level of 15 and, in light of Kirkham's Criminal History Category, a guideline range of 24-30 months. As a result, Kirkham must be sentenced to two consecutive terms of imprisonment, as mandated by 18 U.S.C. 3146(b)(2) and the Guidelines, but in a way that does not exceed a total imprisonment time of 30 months (aside from any departures the district court may justifiably impose).

The district court did not follow these grouping rules when it imposed Kirkham's sentence. Instead, the court appears to have calculated the two sentences separately and imposed them consecutively. Thus, the court sentenced Kirkham to 33 months for his false statements, a sentence which included an upward departure from the otherwise applicable 24-30 month range. It then sentenced Kirkham to a consecutive 24-month term for his failure to appear.3 In other words, the district court seems to have been under the impression that, aside from upward or downward departures, the total time of imprisonment had to be between 39 and 51 months, or between 48 and 60 months,4 depending on the offense level he assigned to the failure-to-appear conviction. Because the Guidelines mandate that the two consecutive sentences be imposed within one applicable Guideline range, in this case 24-30 months, we remand to the district court with instructions to resentence Kirkham within that single range, in accordance with U.S.S.G. 2J1.6, comment. (n.3).5 The sentencing court may use any combination of sentences that it deems appropriate, but the total term of imprisonment must fall between 24 and 30 months, aside from any upward or downward departures that may be justifiably imposed.

B. Validity of the Upward Departure

Kirkham next argues that the district court failed to articulate the reason for or justify the extent of the upward departure it imposed. As noted earlier, the district court departed as to the false statements conviction and may have departed as to the failure-to-appear conviction. The government argues that no remand is necessary because Judge Johnson actually made a substantial upward departure on both convictions, and as a result, was well within the applicable Guideline range.

We reject this argument in large part because we reject the approach to grouping a conviction under section 3146 favored by some of our sister circuits and the government. See United States v. Crow Dog, 149 F.3d 847, 849 (8th Cir. 1998); United States v. Packer, 70 F.3d 357, 360 (5th Cir. 1995). These decisions predate the 1998 Guidelines, which definitely resolve the previous conflict among the circuits regarding the grouping of failure to appear convictions, see U.S.S.G. Supplement to App. C, Amendment 579 (1998) (citing circuit conflict), and which also resolve that Kirkham's failure to appear count should be grouped with his underlying offense. As we have now determined, the district court was operating under a mistaken view of the total guideline range applicable to the grouped offenses. A 57-month total term of imprisonment is an increase of at least 27 months from the applicable Guideline range.

"When the record is ambiguous as to whether a district court has allowed a mistake of law to affect its sentencing decision, we have regularly remanded to allow the court to reconsider its decision in light of our correction of the mistake." United States v. Montez-Gaviria, 163 F.3d 697, 703 (2d Cir. 1998). Therefore, we remand with instructions to the district court to reconsider the extent of its previous upward departure, to make any adjustments it finds appropriate, and to rearticulate the nature and extent of any upward departure it may choose to make upon resentencing.

The sentencing court is, of course, still free to make any departures it deems to be appropriate, if it finds that either of Kirkham's offenses are distinguishable from the "heartland" of cases covered by the Guidelines, or "that there exists an aggravating or mitigating circumstance of a kind, or to a degree, not adequately taken into consideration by the Sentencing Commission in formulating the guidelines." U.S.S.G. 5K2.0.

C. Validity of the Victim-Impact Adjustment

Finally, Kirkham contends that the district court improperly enhanced the offense level for his false statements conviction, pursuant to U.S.S.G. 3A1.2(a), based on the erroneous finding that the government agents involved were "victims" of that offense. His argument is that the only victim of his false statements was the government itself, and that the individual government agents suffered only indirect harm.

We find this argument to be without merit. There was a sufficient showing that the DEA agents Kirkham accused of misconduct suffered adverse professional consequences as a direct result of Kirkham's false statements. This was a sufficient basis on which to apply the three-level enhancement, and we affirm the district court's sentence insofar as it imposed a three-level enhancement on the false statements conviction.

III. CONCLUSION

We find that the sentencing court improperly failed to group Kirkham's failure-to-appear conviction with his false statements conviction. Because the record is ambiguous as to whether the district court allowed this error to affect the extent of its upward departure, we are unable to evaluate Kirkham's challenges thereto. We therefore VACATE the sentence and REMAND for resentencing consistent with this opinion.

There was no trial. He plead guilty to one count of fraud and got time served and the remaining charges were dismissed. As for the US charge his lawyer stated to the court that it was cleared up in the state of New York. Because the paperwork the lawyer provided to the judge is under seal, there's no telling what the paperwork stated but the crown prosecutor agreed with the defense lawyer and concurred that he be released. But I realize that I probably won’t receive my money back and that the scammer will almost certainly never be caught.

That’s depressing to me and other budget travelers, since we’re really the ones with the most to gain from short-term, informal rental agreements. National and international hotel and resort chains don’t fall within our budget range, and it’s not clear we would want to stay there even if they did. After all, there’s something great about renting a real apartment from a real person and living like a real native. You just have to make sure the “real” part is real.

The evangelical broadcaster who left followers crestfallen by his failed prediction that last Saturday would be Judgement Day says he miscalculated.

Harold Camping said it had "dawned" on him that God would spare humanity "hell on Earth for five months" and the apocalypse would happen on 21 October.

Mr Camping said he felt "terrible" about his mistake.

But he said he could not give financial advice to those who spent their life savings in the belief the end was nigh.

Mr Camping had predicted that on 21 May, true believers would be swept up to heaven while a giant earthquake would bring destruction for those left behind.

His independent ministry, Family Radio International, spent millions of dollars on broadcasts, billboards and campaign vehicles to publicise the prediction.

Some followers donated their life savings or simply gave away their worldly possessions as the day approached.

Many expressed bewilderment and shock as the day came and went with no sign of the global cataclysm.

"I've been mocked and scoffed and cursed at," said Jeff Hopkins, a retired TV producer in New York state who spent some of his savings customising his car to showcase Mr Camping's warning.

"It's like getting slapped in the face."
'Not accurate'

Mr Camping had not been seen since Saturday until he appeared on a show on his Open Forum radio show, broadcast from Oakland, California, on Monday to give a 90-minute sometimes rambling presentation that included a question-and-answer session with reporters.

He said that when his prediction had failed to materialise he felt so terrible that he took refuge in a motel with his wife.

He said sorry for not having the dates "worked out as accurately as I could have".

Over the weekend, he said, he had returned to the scripture and it had "dawned" on him that a "merciful and compassionate God" would spare humanity by compressing the apocalyptic destruction into a shorter time frame.

But he insisted 21 October had always been the end-point of his own chronology - or at least his own latest chronology, as a previous prophecy that the apocalypse would strike in 1994 also failed to come to pass.

Asked if he had any advice to offer those who had given away their material wealth in the belief the world was about to end, Mr Camping said they would cope.

"We just had a great recession. There's lots of people who lost their jobs, lots of people who lost their houses... and somehow they all survived," he said.

"We're not in the business of giving any financial advice," he added.

"We're in the business of telling people maybe there is someone you can talk to, and that's God."

Thousands of passengers have had their flights cancelled because of drifting ash from an Icelandic volcano.

About 500 flights were cancelled in Europe on Tuesday, air traffic management body Eurocontrol said.

Flights from some airports in Scotland and northern England would be affected until 0100 BST on Wednesday, air traffic services company Nats said.

But the transport secretary said there should not be significant disruption for UK airports after Tuesday night.

Services at Glasgow, Edinburgh, Newcastle, Barra, Prestwick, Cumbernauld, Tiree, Carlisle and Durham Tees Valley could be affected until early on Wednesday.

UK air traffic control service Nats said the latest information from the Met Office showed no volcanic ash was predicted in UK airspace from 0100 BST on Wednesday.

Nats said further updates would be made if the situation changed and passengers are advised to continue to check with their airline before travelling.

Meanwhile, Germany's Meteorological Service says airspace over the country's northern cities, including Bremen and Hamburg, will close from 0400 BST (0500 local time) because of elevated levels of ash in the atmosphere.

The UK's emergency response committee, Cobra, met earlier to discuss the knock-on effects of the ash cloud.

After the meeting, Transport Secretary Philip Hammond said there was cautious optimism for the coming days.

He said the ash plume had decreased in height and intensity, and south-westerly winds were predicted for the next two days which would move the cloud away from the UK.

The Civil Aviation Authority (CAA) divides the airspace into areas of high-, medium- and low-density ash, and airlines wishing to fly in areas of medium- or high-density ash need to get a safety case accepted by the authority.

Wow, all I am trying to do is install DNN 4.XXX on the web server where my site is hosted (yes it is ASP able, yes I have permissions set, yes I have all DB info). I follow the install (which by the way is no where to be found in the DNN install guide) I found a video online for 3.XXX that I am using. Apparently NO ONE has a need to actually run DNN as a website. I am SO frustruated right now, does anyone have a nice walk through on how to install DNN onto a standard webserver?

Do you know the story about the longest story in the world?

Once upon a time there lived a chief who liked to listen to stories. And he knew so many stories that sometimes he stopped the storyteller and finished the story himself.

One day the chief sent his servants everywhere to find a good storyteller.

"Our Chief will give many presents to the man who will tell him the longest story in the world and make him laugh," the servants shouted in the streets.

Many people came to the chief and told him very long stories. They tried to make him laugh, but nobody could do that. The chief always said, "That is not the longest story and there is nothing to laugh at."

Once a boy came to the chief and said, "Oh, my Chief, let me try to tell you the longest story in the world and make you laugh."

The chief said, "Well, sit down and begin your story!"

The boy began: "Long, long ago there lived a man, Ubanbau by name. He ate so much that no man could feed him full. The chief of that country heard about Ubanbau and said, "Bring him to me, I shall feed him full." And he ordered his people to bring hundreds of thousands of pots of soup, meat, and fruit. Hundreds of camels carried the pots on their backs. The camels stopped in front of the chief's house. Many people came to see Ubanbau's dinner. Then Ubanbau came. Cleaning out some old emails, I came across a time back in 2008 when I was scammed by this same person. I fell for the B&B scam he pulled in Paris. I was young, naive (stupid), and was visiting the city for a friend's wedding. I had never been before and found his listing on Craigslist. Seemed so perfect. In retrospect, too perfect. But he was very helpful with giving me directions and how to arrive in the city, etc. Then 2 days before I was set to arrive, I contacted him with some follow up info. Never ever heard from him. I panicked, realizing what had happened, and hitting myself for being so stupid. Still, I was only out 60 Euros. I feel so sorry for what happened to you here. I only hope justice has been served. A dairy cow in California has bovine spongiform encephalopathy, or "mad cow" disease, the US Department of Agriculture (USDA) has confirmed.

The diagnosis, just the fourth in US history, would not affect beef exports, the department's veterinary chief said.

"Both human health and animal health are protected with regards to this issue," John Clifford said.

The first outbreak of mad cow in the United States occurred in 2003, and hurt global trade in beef.

In a statement, Mr Clifford said that the recently diagnosed dairy cow in central California had not entered the food supply.

"There is really no cause for alarm here with regard to this animal," he said.

The disease was detected as part of a screening programme that tests an estimated 40,000 animals every year, the USDA said.

Canada said it did not expect the diagnosis to affect food trade between the two nations.
Fourth case

Mad cow disease, or BSE, is always fatal in cattle, and research suggests humans can contract a similar deadly brain disease, vCJD, by eating infected meat from infected animals.

The disease causes personality change, loss of body function, and eventually death.

Although infected meat is no longer widely viewed as a risk, there has been continuing concern in the UK over human-to-human transmission through blood transfusions.

The USDA noted that the disease is not transmitted via cow's milk.

According to the USDA, there were only 29 worldwide cases of mad cow disease in 2011.

BSE rose to global prominence in the 1990s with a major outbreak in the UK that prompted fears of large-scale transmission to humans.

The US and many other nations took steps to reduce the spread of the disease, changing animal feed practices seen as enabling transmission among herds.

The California diagnosis is the fourth case of BSE found in the US.

The first was a Canadian-born cow diagnosed in 2003 in Washington state; the others were detected in 2005 in Texas and in 2006 in Alabama.

News of the diagnosis appeared to have an short-term impact on cattle prices: live cattle futures on one US exchange dropped by the daily limit of three cents per pound on reports of the confirmed case, but quickly rebounded.

They all have one thing in common besides being gay, latent homosexuals and passive aggressive, they all have histories that border on criminal when their names are Googled and they all troll the internet and update this site regularly. That's the sad thing.
The pathetic thing is that all these people have nothing better to do with their lives then to Google Sean Kirkham and post links to his very public twitter account.

We are posting this announcement for all existing dealer with 1stdibs.com.

We are informed that the checks initially clear the bank, but funds are later cancelled and withdrawn from the dealer's account, days or even weeks later.

We are further informed that the name being used by the scammer is Sean Kirkham. We do not have information in respect of whether this is a fake name or if this fraudulent scheme may be perpetrated using different names.

Additional information we have been given about how this scammer seems to operate:

We remind you never to agree to falsify values (whether to lower a customer's import duty charges or for any reason) on shipments you make.

-Shipments are made to a Vancouver address, but the check will eventually be returned unpaid after as long as 30 days.

*Note: We are told that checks may take an extended period to clear in Canada (versus the US). When in doubt you should call the (purported) issuing bank and ask about the matter/verify the check. Your own bank may prove useful as a resource also. Do not rely on the phone number that the buyer gives you. Locate the bank's number from a reliable source, such as a phone book. Ensure that it is a genuine bank by doing some basic research. When calling a bank, you should verify the following information: the check number, the name of the person to whom the check was issued, and the amount of the check.

Have you seen this child molester? He is a pedophile in his early 50's, originally from Montreal, Quebec, and now residing in a basement apartment in Marpole, Vancouver. His friend Jeffrey Armstrong - a 'Western Master in Eastern Wisdom' took pity on the child molester and lets him live rent free in exchange for odd jobs around the house.

Michael Matthews declared bankruptcy in 2009 and floats from job to job. Most recently we've tracked him down to a marketing office in Vancouver where he is trying to convince people to purchase low income condo's at a development called Sequel 138.

Michael Matthews abused his young nephew, an 8 year-old boy and was forced to relocate to Vancouver to try to start a new life.

We've attached a few photo's of Michael Matthews as well as his personal information on social media. Child Molesters should be monitored and as a father of two young children, we have to do more to prevent people like Michael Matthews running around.
